The ‘Vertigo of Lists’? Cultural Heritage and Codification

The article explores the relationship between the codification and regulation of cultural heritage, also from a historical and comparative perspective. In particular, the author examines the 20 years of the Code of Cultural Property and Landscape (Legislative Decree No. 42 of 22 January 2004). The analysis focuses on the context, legacy and points of tension that characterized the preparation of the Code, the choices made, and the gaps in the legislation, as well as the trends towards change that have emerged in recent years. Finally, some concluding remarks are made as an overall assessment of these 20 years and the future of the Code.
