Review of Independent Authorities: the Agcom Case

This overview examines some changes review of the regulatory acts adopted by the Italian Regulatory Authority for Electronic Communications (AGCOM). The contribution of European law to the delineation of the boundaries of judicial review, in both substantial and procedural terms, is very important. This path reveals certain general aspects, among which the main one is the effectiveness of judicial protection — which appears to gain strength due to the refinement of the techniques applied. The path is as yet incomplete, but is nevertheless already defined.
